gavel1. Substantial Risk of Trading Futures, Forex & Equities
The risk of loss in trading commodity futures contracts, foreign exchange (Forex), equities, options, and digital assets can be substantial. You should carefully consider whether trading is suitable for you in light of your financial condition, investment experience, and risk tolerance.
You may sustain a total loss of initial margin funds and any additional funds that you deposit with your broker to establish or maintain a position. If the market moves against your position, you may be called upon by your broker to deposit a substantial amount of additional margin funds on short notice. If you fail to provide the required funds within the time required by your broker, your position may be liquidated at a loss, and you will be liable for any resulting deficit in your account.

2. CFTC RULE 4.41 — HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY.

FXUtilsy is an independent software application designed to help individual traders organize their trading journals, track R-multiples, audit planned vs actual slippage, and calculate contract sizing based on user-provided variables.
- No Signals or Recommendations: FXUtilsy does not provide automated buy/sell signals, market predictions, or financial advice.
- User Autonomy: Every trade execution, order type, entry point, stop-loss placement, and risk parameter is set, entered, and executed solely at the discretion of the user.
- No Guarantees: Process compliance scores (e.g., “Grade A+”) measure personal discipline adherence against user-defined strategy checklists. A high process score does not guarantee market profitability or protect against black swan market moves.
4. Proprietary Trading Firm Evaluation Risks
Many traders use FXUtilsy to track progress within proprietary evaluation challenges (such as Apex Trader Funding, Topstep, FTMO, and MyFundedFutures). Please be aware of the following:
- Statistically, the majority of traders who purchase prop firm evaluations fail to achieve or maintain funded status due to strict trailing drawdown, intraday loss caps, and psychological pressure.
- FXUtilsy's drawdown alarms and position sizing engine are calculation aids. They do not prevent a broker from liquidating accounts if trailing drawdown limits are breached.
- Evaluation fees paid to third-party prop firms are non-refundable and separate from FXUtilsy software subscription fees.
5. System Latency, Broker API & Slippage
Calculations displayed in FXUtilsy (including tick sizing, planned vs actual variance, and expectancy) rely on data inputs from users and third-party CSV files. Market prices, bid/ask spreads, and execution fills can vary rapidly during high-volatility news events (e.g. CPI, FOMC, NFP). Real execution prices may suffer substantial slippage compared to theoretical trade plans.
